Resources say that on court day Higgs asked to have his case remanded back to the District Court charges. Obviously just like in my case he was going to get it.

Will Judge Frank Brown save Higgs before he retire in the very near future? Higgs was suppose to appear in court in July however it was continued to August. Why? Because he wanted the case to be heard by Judge Frank Brown in my opinion. He tried that with me when he appealed my case against him to Superior Court and he prolonged it about a year but justice prevailed.

Higgs to appear in Superior Court again on Monday August 11, 2008 for assault on a female. Guess who? His neice.

C. Dancy II - TPA Opinion: They did the right thing and not responded because they skirted around the issue of residency. Ms. Brunson arrived at the meeting after the residency challenge was over so therefore she miss all of the hearing.

On April 11, 2008, you filed a complaint in our office concerning a housing code violation against Roosevelt Higgs located at Lot 58 Staton Estates Subdivision located off on Gray Street off Norfleet Street and NC 122 North in Township No.4 in the Speed Community. On April 14, 2008, staff from the Planning and Inspections Office did an on-site inspection and reported that there was not a habitable structure on site for a permit to be issued. However, the on-inspection revealed other violations which include Junked and Abandoned Vehicles Ordinance and Solid Waste Ordinance. These violations will be dealt with accordingly.

C. Dancy II – Opinion: In this information I read that there is no such address as Lot 58 Gray Drive Tarboro NC. Roosevelt has been using this address for several years and in my opinion this is a not a real address. This is what I found when I sent a certified letter to Lot 58 Gray Drive Tarboro NC in 2007 that was returned to me.

NC NAACP is Encouraged by Voting Rights Court Case Victory
 
Earlier this week, the NC Court of Appeals ruled in favor of a sitting African American Rocky Mount City Councilman and Rocky Mount NAACP President, Mr. Andre Knight.  Knight’s place of residence in Rocky Mount had been challenged by Roosevelt Higgs, in an attempt to remove Mr. Knight off the Edgecombe County voter registration rolls. 
 
Higgs’ challenge was upheld by the Edgecombe County Board of Elections and the Edgecombe Superior Court, when the procedure followed by the local officials was reviewed by the State’s second highest court, it was found to be fatally flawed.   The Court of Appeals chastised the Edgecombe County officials for allowing and sanctioning the violations of Mr. Knight’s fundamental due process rights.  The Court found that the Edgecombe Board of Election’s refusal to even consider Knight’s request to recuse the Chairman of the Board, after she had already declared publicly her conclusion about Knight’s residency, was a violation of Knight’s constitutional rights.  Further, the Court found the Board violated the Open Meetings law and violated Knight’s rights when it convened closed sessions without proper process and notification.
 
NC State Conference of Branches President Dr. William Barber said: “This ruling reinforces the need for strong Voting Rights legislation and enforcement in most of our Eastern Counties.  It also shows the need for the election of objective judicial officers.  A clearly flawed and biased political infrastructure in this rural North Carolina community attempted to hold justice hostage.   Knight, and all the strong leaders who are challenging the status quo were redeemed, however, by the fairness of a higher court.  The relentless advocacy of a strong soldier of justice prevailed.”
 
Knight, who was twice elected by overwhelming margins in the face of allegations that he did not live in his Council district commented on his victory: “The people’s voices today were supported by the North Carolina courts.  It shows that a few kingpins of the old status quo cannot bend and shape the law to fit their opinions.  America is supposed to be a land of opportunity and freedom.  In Rocky Mount and eastern North Carolina , the freedoms of African Americans and other people of color have been suppressed, denied and violated for too long.  The challenge of my residency was never about me.  It was about the election of a majority African American City Council being elected in a growing and important eastern North Carolina City .  I trust our citizens have hope again that our votes do count.”
 
Dr. Barber commented: “Voting rights and political access are fundamental to the fabric of hope in our country and our state.  We are thankful that North Carolina stood up for justice and progress on the eve of potentially the largest and most important primary election in history in terms of voter turnout.  Mr. Knight’s attorneys, Antonia Lawrence and Mike Crowell, deserve a special thank you for their clarity and preciseness in exposing the unfairness in Edgecombe County to the Court of Appeals.
 
“This is a timely event for the NAACP,” Dr. Barber said, “as we have helped register hundreds of thousands of North Carolinians .  We want everyone voting to know that their votes are protected by law and valued by the legal and election infrastructure.  We will not allow North Carolina to go down in history as a state like Florida that is known for suppressing voters and stealing votes.  We want to lead the nation in voter registration, education, mobilization and protection.”

We do not think the Edgecombe County Board of Elections had any choice Tuesday than to find Andre Knight is not a resident of the county.
That's what the evidence showed although plenty of people gave sworn testimony he lived at 1517 Cherry St. in Rocky Mount, which is in Edgecombe County.

C. Dancy II - TPA Opinion: Well thank you Jeff you are finally saying what I have been saying for many years now. It is so sad that some white folks will attach themselves with a known black criminal like Higgs over Andre Knight who many didn't and still don't know. The problem is these very folks feel threatened by Knight however some are scared of Higgs. I know that to be factual because I have set in meetings several years ago with Gladys Shelton and others in the Democratic Party in the Edgecombe County Administration Bldg Conference room and everytime someone would come in Shelton would say she thought it was going to be Higgs. She admitted that she was scared of him.

Rocky Mount NC - Appeals court overturns residency decision

The N.C. Court of Appeals ruled in favor of a Rocky Mount councilman regarding a residency challenge that has been ongoing since 2006.

The N.C. Court of Appeals ruled in favor of Ward 1 Councilman Andre Knight on the basis that improper proceedings were carried out by the Edgecombe County Board of Elections during the original hearing held by the board in 2006.
