The court has determined, puruant to G.S. 15!-1340.20, the number of prior convictions to be 5. Level III (5 +)

The Court, having considered evidence, arguments of counsel and statement of defendant, Order that the above offenses, if more than one, be consolidated for judgement and the defendant be imprisoned for a term of 45 days in the custody of the: Sheriff of Edgecombe County.

The defendant shall be given credit for -0- days spent in confinement prior to the date of this Judgment as a result of this charge(s), to be applied toward the

SUSPENSION OF SENTENCE

Subject to the conditions set out below, the execution of this sentence is suspended and the defendant is placed on unsupervised probation for 12 months.

The defendant shall pay to the Clerk of Superior Court the "Total Amount Due" shown below set out by the court as follows:

Curmilus Dancy Versus Roosevelt Higgs

NO -CONTACT ORDER

The Court hearby finds that:

3. The plantiff has suffered unlawful conduct by the defendent in that:

(1.) On 10-1-07 deft. (despite pl's wish to be left alone) left a recorded message on pl's phone wherein deft. called pl. profane names mutliple times. (2.) On 10-3-07 deft again called pl. despite pl's wish to be left alone. (3.) On 10-3-07 pl's wife received pictures of the pl. (taken by deft.) and a letter to pl's wife asking her to share said pictures with ".... children, family & friends.) The pictures & letter were sent despite the pl's desire to be left alone.

CONCLUSIONS

1. The defendent committed acts of unlawful conduct against the plantiff.

ORDER

It is ORDERED that:

1. The defendant not visit, assault, molest or otherwise interfere with the plaintiff.

3. The defendant cease harassment of the plaintiff.

4. The defendant not abuse or injure the plaintiff.

5. The defendant not contact the plaintiff by telephone, written communication, or electronic means.

6. The defendant not enter or remain present at the plaintiff residence, place of employment, and other places listed below at times when the plaintiff is present.

At any public meeting, the deft. shall at no time harass the pl. & at no time shall address the pl. directly. The deft at no time shall take any pictures of the pl nor his family. The deft shall not contact the pl or his family at any time.

8. The terms of this order shall be effective until 1 year from the date of this order.

This is not only a victory for me but for the many women he has harassed that others and I have witnessed over the years. He has harassed Geonetre Penny-Boone current County Chair, Gladys Pitt Shelton former County Chair and Treasurer, Elizabeth Ohree former Precinct Chair, County Commissioner Viola Harris and former County Secretary, Dr. Florence Armstrong former County Chair and now current Secretary, Rev. Celestine Lyons former County Chair and the list goes on. I have stood up for all of them because I was a member of the Edgecombe County Democratic Party Executive Committee when he did such. I was mad as hell when several men such as Rev. William Clayton, Rev. Roy Gray, Commissioner Leonard Wiggins and some others did nothing. 

When I joined the Democratic Party I served faithfully at the Precinct level before moving on to the County level. My main goal was to hold our party be it party members ie: elected officials all accountable for their actions. I had to stand alone many of times as I had to deal with Higgs and some of his supporters who allowed him to manipulate the party process because the others didn't read their Plan of Organization as thorough as Higgs. They would always say Higgs knew what he was doing because he didn't work anywhere and he had time to read. Well hell I worked several jobs back then and I read the Plan of Organization and I could challenge him and others.

The last time I served on the county level is back in the early 2000's under the leadership of Higgs and he was the chair. I could not stomach anymore and my mission was to remove him from the party so that the party could move forward in unity. He has since been removed from the county executive committee (6 officers) and only serves as a precinct vice chair.

I tried to get Higgs to do the right thing when I served at the county level and he would not, so therefore this is where we are today. With an historical Election Year I hope that with the limited voice of Higgs that the Edgecombe County Democratic Party can move forward in unity and be able to focus on electing good Democrats without the distraction of Higgs.
